Terms, Conditions and Privacy Policy of the Executive Program in Energy Literacy for a Sustainable Future

1. Definitions

  1. “TEA ACADEMY” means Thailand Energy Academy, which was founded by the PTT Group in collaboration with the Ministry of Energy and is a division of PTT Public Company Limited (“PTT”)  
  2. “TEA”  means the Executive Program in Energy Literacy for a Sustainable Future, which is one of the courses offered by TEA ACADEMY.
  3. “Personal Data” means information about a person that allows such person to be identified whether directly or indirectly, but does not include specific information of a deceased person, such as first name - last name, identification code of the participants, address, occupation, job title, phone number, fingerprint, photo, ID card number, spouse's name, parents' name, secretary's name, telephone number of the secretary and/or any other information about the applicants, the participants or the alumni that have been furnished to TEA ACADEMY.
  4. “Applicants” means applicants who express their intention to enroll in the TEA executive program.
  5. “Participants” means applicants who have been accepted into the program and whose registration form has been completed.
  6. “Alumni” means those who have completed the TEA executive program as approved by the TEA ACADEMY Committee.
  7. “User Account” means an account that has been created for the applicants, the participants or the alumni to use for logging into TEA ACADEMY’s electronic system.
  8. “User ID” means any login name or username, password, Pin-Person Identification Number, fingerprints, as well as any other codes associated with the use of the electronic services, irrespective of how they are referred to, and whether they are provided by TEA ACADEMY or personalized by the applicants, the participants or the alumni.

2. Admissions

  1. When the applicants submit their application to TEA ACADEMY together with the required information, such as their first and last names, job titles, places of employment, and contact information, TEA ACADEMY will consider making its selection based on the criteria and conditions prescribed by TEA ACADEMY. If TEA ACADEMY receives information from the applicants that is found to be wrong, incomplete or inconsistent with the facts, TEA ACADEMY reserves the right to reject the application without prior notice, and TEA ACADEMY shall not be held responsible for any resulting damage.
  2. When the applicants have been accepted into the program, a formal invitation will be extended to the applicants who will be given with their User ID to log into their User Account to access and fill out all information required in the system.
  3. Tuition fees and payment methods are determined in accordance with TEA ACADEMY’s criteria and conditions.

3. Use of TEA ACADEMY’s electronic system

  1. By using TEA ACADEMY’s electronic system, you allow TEA ACADEMY to record and archive your data in its database for the purpose of conducting business with TEA ACADEMY as described herein, and you agree to keep your User ID confidential and to refrain from disclosing or acting in any way that would allow others to learn your User ID.
  2. You can use each electronic system service only if you agree to all applicable terms of service and/or take any other action as required by TEA ACADEMY, and you must be bound by and comply with the terms and conditions of use set forth by TEA ACADEMY for each service and/or terms and conditions of use for each type of service that has existed before and/or during the course of your transaction (if any). These terms and conditions, intentions, registrations are deemed to be incorporated into this document.
  3. Those who already have a TEA ACADEMY User Account can access and review their personal data that TEA ACADEMY electronically records. If you wish to make changes to your electronic data stored in the system, you must contact TEA ACADEMY via the communication channels specified in clause 4.10.
  4. When you cease using your User Account and/or your User Accounts is deactivated, TEA ACADEMY will continue to keep your account data in its database for future reference in connection with TEA ACADEMY's electronic usage, or until such information is no longer required for TEA ACADEMY’s use.

4. Privacy Notice

       TEA ACADEMY places a premium on the protection of the applicants', participants', and alumni's personal data. To ensure compliance with the Personal Data Protection Act B.E. 2562 (2019), TEA ACADEMY would like to inform you that it is necessary for TEA ACADEMY to collect, use, and disclose personal data (collectively referred to as personal data processing) from the time an application is submitted for consideration, throughout the selection process, during the training, and after the course is completed. Details concerning the collection, use, and disclosure of personal data, your rights as a data subject, and how to contact TEA ACADEMY are as follows:

4.1 Personal data that is to be collected

       4.1.1 During application submission, TEA ACADEMY will collect personal data from the applicants, such as first name, last name, address, age, occupation, unit/organization, email address, and phone number, etc. as well as any other information supplied by the applicants to TEA ACADEMY as part of the admissions process.

       4.1.2 When applicants are accepted into the program

               4.1.2.1 TEA ACADEMY may collect additional personal data from the participants, such as photographs or motion images or CCTV recordings, contact information, such as Line's unique identifier (UID), and other information included in the program registration form and/or questionnaires provided by TEA ACADEMY, such as participation questionnaires. If the applicants or the participants do not intend to provide information in any of the items on the forms, they must indicate this with a “-” sign.

               4.1.2.2 In general, TEA ACADEMY has no intention of collecting and using religion and blood group information included in copies of the applicants’ or the participants’ identification cards or other papers containing their personal information for any particular purpose.

                       If the applicants or the participants have given TEA ACADEMY with a copy of their ID card, such information must be redacted. If the applicants or the participants do not conceal such information, it will be presumed that the applicants or the participants authorize TEA ACADEMY to redact such information and that the redacted documents remain in full force and effect and can be enforced in accordance with relevant laws in all respects. If TEA ACADEMY is unable to redact information owing to technical constraints, the information will only be collected and used as part of the document authenticating your identity.

                       Personal history records do not compel the applicants or the participants to provide sensitive personal information such as ethnic origin, religion, or blood group. If you provide TEA ACADEMY with personal papers containing such sensitive information, TEA ACADEMY will redact the sensitive information. If TEA ACADEMY is unable to obscure such information due to technical constraints, TEA ACADEMY will collect and use it solely as part of the admissions supporting materials.

               4.1.2.3 TEA ACADEMY may process certain sensitive personal data (Sensitive Data) of the applicants or the participants, such as fingerprints, etc. If it is necessary for TEA ACADEMY to collect such sensitive data, it will do so with the applicants’ or the participants’ explicit consent on a case-by-case basis.

               4.1.2.4 TEA ACADEMY may capture still and motion images and record sounds in video format throughout the course of the program, field trips, seminars, and various curriculum activities related to teaching and learning for the TEA executive program. Images and audio, participants’ opinions, answers, and other participant activities may be recorded.

       4.1.3 TEA ACADEMY may record conversations between the applicants or the participants and TEA ACADEMY and/or collect, record and/or process data, including personal data of the applicants or the participants and/or take any other actions necessary to improve TEA ACADEMY's services.

       4.1.4 In case the applicants and/or the participants provide insufficient or out-of-date personal information, TEA ACADEMY may seek more information or verify the information provided by the applicants and/or the participants from publicly available sources to complete and update the information.

       4.1.5 In case the applicants and/or the participants provide TEA ACADEMY with information about other individuals associated with the participants, such as first and last names, telephone number or contact information of their secretary, spouse's information, information about the contact person in case of emergency, etc., the applicants and/or the participants certify that they have the authority to provide such information and authorize TEA ACADEMY to process such personal data in accordance with this document. The applicants and/or the participants are responsible for notifying and obtaining consent from such third parties regarding the terms of this document (if necessary).

       4.1.6 After the participants complete the program successfully, TEA ACADEMY will continue to retain your personal data as an alumnus, including your name title, first and last names, address, age, telephone number, occupation, unit/organization, email address, class of the TEA executive program, etc. In addition, TEA ACADEMY may request for additional information such as data concerning the current job titles, contact data of the alumni’s secretary, data concerning opinion, recommendation, satisfaction, other data as provided in questionnaire or other data concerning the participation of activities such as registrations data, ID card number, the non-preferred food, photo, shirt size, etc.

       4.1.7 In case the alumni do not maintain their personal data current, TEA ACADEMY may look for more information or compare the alumni’s personal data recorded with TEA ACADEMY to any available sources in order to update and complete their information.

       4.1.8 In case the alumni provide TEA ACADEMY with information about other individuals associated with the alumni, such as first and last names, telephone number or contact information of their secretary, spouse's information, information about the contact person in case of emergency, etc., the alumni certify that they have the authority to provide such information and authorize TEA ACADEMY to process such personal data in accordance with this document. The alumni are responsible for notifying and obtaining consent from such third parties regarding the terms of this document (if necessary).

4.2  Objectives and legal basis for the collection, use and disclosure of personal data
       4.2.1 For the applicants and/or the participants

               In processing the personal data of the applicants and/or the participants entering the TEA executive program, TEA ACADEMY will collect, use and disclose personal data within the scope of the objectives of which the applicants and/or the participants are advised on the legal basis of processing personal data in accordance with the laws as follows:

       4.2.1.1 Contract fulfillment or processing of a request prior to contracting for the following purposes:

  1. Collection, use and disclosure of the applicants’ personal data for the purpose of the program’s selection process.
  2. Collection and use of the participants' personal data as a history record of attendance at TEA ACADEMY's courses or to develop a contact database for the program.
  3. Collection and use of the participants' personal data for the purpose of communicating the program's curriculum, informing participants of program schedules and other program-related information throughout the course, such as opening ceremonies, educational visits, course syllabus, closing ceremonies, and relationship-building activities.
  4. Collection and use of the participants' personal data in order to verify their eligibility to attend the program or participate in extracurricular activities associated with the TEA program.
  5. Collection and use of the participants' personal data for the purpose of administering the program, evaluating participants during training, and distribution of academic material.
  6. Collection, use, and sharing of the participants' personal data for the purpose of making training mementos and equipment, such as name tags, graduating class shirts, pamphlets, and certificates, and so on.
  7. Collection, use and disclosure of the participant’s personal data for the purpose of preparing food and beverages during training.
  8. Collection and use of the participants' personal data for the purpose of verifying tuition fee payment.
  9. Collection, use, and sharing of the participants' personal data for the purpose of arranging domestic and overseas field trips.
  10. Collection, use, and dissemination of the participants' personal data for the purpose of acquiring travel accident insurance, reserving accommodations, and purchasing travel tickets for domestic and foreign field excursions.
  11. Disclosure of the participants' personal data as background information for speakers from domestic and international agencies and institutions preparing content for the training.
  12. Collect and utilize personal data of the applicants and/or the participants in order to keep track of their usage of the electronic system.

       4.2.1.2  Necessity for legitimate interests in the following instances:

  1. Collection and use of the participant’s personal data in order to survey their opinion, recommendation or satisfaction with the program, including the development and enhancement of the TEA ACADEMY’s activities.
  2. Collection and use of the applicants’ and/or the participants’ personal data for the analysis of TEA ACADEMY training management or for the improvement of TEA ACADEMY services or products or those associated with TEA ACADEMY.
  3. Collection and use of the participants' personal data in order to track their course history with TEA ACADEMY and to develop a contact database for TEA ACADEMY participants.
  4. Collection, use and disclosure of the participants’ personal data for communication between the participants and TEA ACADEMY or the participants of the same class, as well as for building networks and relationships, such as the disclosure of certain personal data in a directory via mobile applications, etc.
  5. Collection and use of the applicants' or the participants' personal data for account and network security purposes, including the protection of TEA ACADEMY's system and the filtering or monitoring of content considered illegal within the framework of legitimate interests.
  6. Recording motion images, sounds, or other activities during training so that participants can study and watch replays.
  7. Videotaping interviews, question-and-answer sessions, and participant feedback for analyzing TEA ACADEMY's training management or refining TEA ACADEMY services, and releasing them to future class participants for program public relations purposes.
  8. Collection, use and disclosure of the participant’s personal data for program public relation purposes, which may include photos, names, job titles, the division for which the participants work, as well as photos of the training events, etc. on website : https://www.thailand-energy-academy.org
  9. Collection and use of the contact information of the participants' secretaries (if any), as well as releasing such information to other participants from the same class for the purpose of facilitating communication among program members.
  10. Collection and use of contact information submitted by the participants via methods specified by TEA ACADEMY for the purpose of promoting TEA executive program-related news and events, such as academic seminars, field trips, and relationship building activities.

       4.2.1.3 The prevention or suppression of danger to a person’s life, body, or health.

       4.2.1.4 Compliance with the law for the following purposes:

               Collection, use and disclosure of personal data of the applicants or the participants for the purpose of complying with legal obligations and legal enforcements, including reporting or disclosing information to government agencies, regulatory agencies, state-owned enterprises, government authorities, public organizations, independent organizations established by law or other agencies as required by law, including officers who exercise their power or perform statutory duties, or when a summons or a seizure warrant is issued by police officers, government authorities or courts.

       4.2.1.5 Consent required for the following purposes:

  1. Collection and use of personal data of the applicants who are not accepted into the program for future TEA applications.
  2. Collection and use of your first and last names, and contact information, such as address, phone number, email, etc., for publicizing information or other interesting activities, including news update or upcoming events from TEA ACADEMY once you have completed the course, via mail and/or phone messages and/or e-mail or other communication channels you have specified. In the case that TEA ACADEMY assigns such tasks to its representatives, contractors/subcontractors, and/or service providers for public relations objectives, TEA ACADEMY may release such information to those individuals.
  3. Collection and use of the participants' sensitive data, such as fingerprints, to record their entry and exit times during the course. TEA ACADEMY may share such information to its representatives, contractors/subcontractors, and/or service providers in connection with the development or maintenance of TEA ACADEMY's fingerprint recording system.
       4.2.2 For alumni

              After the participants have finished the program, TEA ACADEMY may continue to process your personal data as a program alumnus. TEA ACADEMY will collect, use and disclose the personal data in line with applicable legislation in order to accomplish the objectives as follows:

               4.2.2.1 Necessity for legitimate interests in the following instances: ดังต่อไปนี้

  1. Collection and use of alumni personal data to survey their opinion, recommendation or satisfaction with program participation or other TEA ACADEMY’s activities, including the development and improvement of TEA ACADEMY training programs and activities.
  2. Collection and use of alumni personal data to study TEA ACADEMY's training management or to improve TEA ACADEMY's services or products or those associated with TEA ACADEMY.
  3. Collection and use of alumni personal data in order to track their course history with TEA ACADEMY and to establish a contact database for TEA ACADEMY participants. Such information may be shared to your division (if you apply for the program through your division) in order to present your course attendance and/or to serve as supporting information in the process of nominating individuals for the program of future classes.
  4. Collection, use and disclosure of personal data of the alumni for communication between the alumni and TEA ACADEMY or the alumni members from the same class, as well as for building networks and relationships, such as the disclosure of certain personal data in a directory via mobile applications, etc.
  5. Collection and use of alumni personal data for account and network security purposes, including the protection of TEA ACADEMY's system and the screening or monitoring of content considered illegal within the framework of legitimate interests.
  6. Collection, use, and dissemination of alumni personal data for program public relations purposes, which may include images, names, job titles, the division for which the alumni work, as well as photos of training events, etc. on https://www.thailand-energy-academy.org
  7. Collection and use of the contact information of the alumni’s secretaries (if any), as well as releasing such information to other alumni of the same class for the purpose of communication among the alumni members.
  8. Videotaping interviews, question-and-answer sessions, and participant feedback in order to analyze TEA ACADEMY's training management or to improve TEA ACADEMY services and to distribute them to future class participants for program public relations purposes.
  9. Collection, use and disclosure of personal data of the alumni for registration and verification their eligibility to attend the activities, the proper preparation of activities including the provision of facilitation such as for arranging domestic and overseas field excursion, reserving accommodations, vehicle reservation, acquiring travel accident insurance, catering of food and beverage, preparing the mementos and equipment for the activities, informing participants of activities schedules, etc.
  10. Collection and use of alumni personal data for publicizing information or other interesting news.

               4.2.2.4 Consent required for the following purposes:

                       Collection and use of your first and last names, and contact information, such as address, phone number, email, etc., for publicizing information or other interesting activities, including news update or upcoming events from TEA ACADEMY once you have completed the course, via mail and/or phone messages and/or e-mail or other communication channels you have provided to TEA ACADEMY. In the case that TEA ACADEMY assigns such tasks to its representatives, contractors/subcontractors, and/or service providers for public relations objectives, TEA ACADEMY may release such information to those individuals.

      4.2.3 For secretaries or other person that the applicants, the participants or the alumni provided

               TEA ACADEMY may collect your personal data such as your first and last names, telephone number, email address, or other contact information from the applicants, the participants, or the alumni of the TEA program, where TEA ACADEMY may have obtained the data on the basis of its legitimate interests in collecting and using your personal data for communication including for communication in case of emergency, and TEA ACADEMY may disclose such personal data of the secretaries of the applicants or the alumni to other participants or alumni to facilitate communication between participants and/or alumni from the same class.

4.3  Disclosure of Personal Data

       TEA ACADEMY may disclose your personal data to the following third parties as necessary to carry out the purposes described herein.

       4.3.1 The Ministry of Energy

       4.3.2 PTT Group companies

       4.3.3 Government agencies, regulators, state-owned enterprises, government authorities, public organizations, independent organizations that are established in accordance with the law or other agencies as required by law, including officers who exercise their legal authority, such as courts, police, the Revenue Department, the State Audit Office, the Office of the National Anti-Corruption Commission, etc.

       4.3.4 Speakers

       4.3.5 Companies, agencies, or other external groups to help with field trip planning.

       4.3.6 Representatives, contractors/sub-contractors and/or service providers for related responsibilities such as:

  1. Juristic persons or any other person with whom TEA ACADEMY is a party or has legal relations for the benefit of TEA ACADEMY’s internal operations or the service provision or for participant convenience, and TEA ACADEMY may disclose such participant personal data to persons or entities located outside the country for the benefit of the participants.
  2. Auditors, internal and external auditors of TEA ACADEMY, or business alliances and cloud system providers.

       4.3.7 Other participants or alumni who have attended TEA ACADEMY's courses for the purpose of facilitating communication and/or building up networks and relationships, such as sharing personal data in a directory via a mobile application, etc., or for other objectives specified in this document.

       4.3.8 Visitors to the Thailand Energy Academy's website, https://www.thailand-energy-academy.org However, only information relevant to program public relations will be available, such as photographs, participants' names, positions, divisions for which they work, and photographs of training activities.

       4.3.9 The divisions for which the participants work. Data given to the persons in this section is intended to serve as supporting information in the process of nominating candidates for future classes’ programs.

       4.3.10 Hospital or clinic.

4.4 Limitations/ disadvantages due to insufficient information

       The applicants have the right to withhold certain personal data from TEA ACADEMY. In case the applicants provide required information that proves to be insufficient, TEA ACADEMY reserves the right not to consider their applications without prior notice, and TEA ACADEMY shall not be held responsible for any resulting damage whatsoever.

       If the participants supply insufficient information upon registration in TEA ACADEMY's system, they may encounter problems or be denied some services. TEA ACADEMY maintains the right to take appropriate measures, and TEA ACADEMY will not be held liable for any inconvenience or non-provision of service to such participants.

4.5 Public relations and news update

       TEA ACADEMY shall communicate with the participants and/or the alumni regarding TEA ACADEMY's news update and upcoming events in accordance with the objectives specified in Clauses 4.2.1.4 and 4.2.2.3 via the communication channels specified by the participants and/or the alumni.

4.6 Rights of the Data Subject

       You have rights under the Personal Data Protection Act B.E. 2562 (2019) in relation to your personal data and may exercise those rights by contacting TEA ACADEMY via the means mentioned in Clause 4.10. When the Personal Data Protection Act becomes effective and applies to TEA ACADEMY (PTT), you may exercise the following rights:

       4.6.1 Right to withdraw consent

               If TEA ACADEMY receives your consent for the collection, use, or disclosure of your data, you have the right to withdraw your consent at any time, unless the withdrawal of consent is prohibited by law or a contract that benefits you.

               Withdrawing consent will have no effect on the authorized processing of your personal data by TEA ACADEMY. Additionally, in some situations, withdrawing your consent may result in decreased convenience for the services, loss of future advantages and special offers, or other negative consequences for your use of the TEA ACADEMY's services.

       4.6.2 Right to Access

               You have the right to request access to and obtain a copy of your personal data held by TEA ACADEMY, as well as to request that TEA ACADEMY disclose how such personal data is collected without your consent.

       4.6.3 Right to Data Portability

               In the event that TEA ACADEMY has stored your personal data in a format that is readable or commonly used by ways of automatic tools or equipment, and can be used or disclosed by automated means, you have the right, in accordance with the law, to receive your personal data from TEA ACADEMY including the following rights:

  1. Request TEA ACADEMY to send or transfer the personal data in such formats to other data controllers if it can be done by automated means.
  2. Request to obtain the personal data that TEA ACADEMY sends or transfers directly to other data controllers in such formats except where technical limitations make this impossible.

       4.6.4 Right to Object

               You have the right to object to the processing of your personal data in respect of the collection, use or disclosure of personal data for direct marketing purposes and in other cases as permitted by law.

       4.6.5 Right to Erasure

               You have the right to request that TEA ACADEMY remove, destroy, or anonymize your personal data in order to transform it into anonymous data that cannot be used to identify the data subject in certain conditions as defined by law.

       4.6.6 Right to Restriction of Processing

               You have the right to request that TEA ACADEMY stop using your personal data under specific circumstances as stipulated in the law.

       4.6.7 Right to Rectification

               TEA ACADEMY makes every effort to keep your personal data correct, up-to-date, complete, and make sure it is not misleading. If you believe that the information kept with TEA ACADEMY is incorrect or that your personal data has changed, you have the right to request that TEA ACADEMY change your personal data to ensure that the data is correct, up-to-date, comprehensive, and not misleading.

      4.6.8 Right to complaint

               You have the right to lodge a complaint with competent authority in accordance with the Personal Data Protection Act B.E. 2562 (2019) in the event that TEA ACADEMY violates or fails to comply with such act.

4.7  Period of retention of personal data

       TEA ACADEMY will keep your personal information for as long as it is necessary for collecting, utilizing, or disclosing personal information in order to achieve the goals outlined in this policy. The retention period is determined by the length of time that TEA ACADEMY maintains or provides services to you, the length of time that TEA ACADEMY requires for legitimate business purposes, and any reasonable period that TEA ACADEMY may continue to retain personal data in order to comply with the law or in accordance with the statute of limitations for establishing a cause of action, legal compliance, exercising legal claims, or legally counterclaiming or for other reasons in accordance with TEA ACADEMY's internal policies and requirements.

At the end of the retention period, TEA ACADEMY will erase or destroy the personal data within 60 (sixty) days from the end of the retention period.

4.8 Transmission of personal data to foreign locations

       In some cases, TEA ACADEMY may send or transfer your personal data to a foreign country. In doing so, TEA ACADEMY shall comply with the Personal Data Protection Act B.E. 2562 (2019).

4.9 Amendment of this Privacy Notice

       TEA ACADEMY reviews this document on a periodic basis and may make changes to the terms of personal data protection in this document as deemed necessary to guarantee that your personal data is adequately protected. TEA ACADEMY will notify you via TEA ACADEMY's website or the email address you specify whenever the terms of personal data protection are altered.

4.10 Communication channels        

       If you require any information or wish to exercise your data subject rights, including the right to withdraw previously granted consent, you may contact TEA ACADEMY at the address below.
